Welcome to Carta! These Terms and Conditions govern your access to and use of the Carta application and services. By accessing or using the App, you agree to comply with these Terms. If you do not agree, please do not use the App or Services
1. Acceptance of Terms:
By creating an account or using our Services, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.
2. Account Registration:
To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
3. Services:
Carta connects users with local restaurants and delivery partners to facilitate food delivery. We do not own or operate the restaurants listed on our App and are not responsible for their actions or inactions (This includes cold food upon delivery).
4. Orders and Payment:
When you place an order through the App, you agree to pay the total amount, including the price of the food, applicable delivery fees, and taxes. All payments are processed through our third-party payment processor (Stripe). You are responsible for providing accurate payment information.
5. Delivery:
Delivery times are estimates and may vary based on factors such as restaurant preparation time, traffic conditions or weather. Carta is not responsible for delays in delivery.
6. Cancellations and Refunds:
You may cancel your order before it is accepted by the restaurant. Once accepted, any cancellation may incur a fee. Refunds are subject to our refund policy and will be processed through the payment processor (This could take up to 7 days).
7. User Conduct:
You agree not to use the App or Services for any unlawful or prohibited purpose. This includes, but is not limited to, harassment, fraud, and any activity that could damage, disable, or impair the App.
8. Intellectual Property:
All content, trademarks, and other intellectual property rights related to the App and Services are owned by Carta or its licensors. You may not use any of our intellectual property without our prior written consent.
9. Limitation of Liability:
To the fullest extent permitted by law, Carta shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App or Services.
10. Indemnification:
You agree to indemnify and hold harmless Carta, its affiliates, and their respective employees, officers, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the App or Services or violation of these Terms.
11. Changes to Terms:
Carta reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms in the App. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
